8-4-1: DEFINITIONS:
NATURAL FENCE: Same as a structural fence, except that it is made of natural growth such as shrubs, hedge, evergreens, etc.
STRUCTURAL FENCE: A structure which is a barrier and is used as a boundary or means of protection or confinement which is made of manufactured material such as, but not limited to, wire mesh, chainlink, wood or stone material. (Ord. 209-74, 7-9-1974)
8-4-2: FENCES PROHIBITED:
No structural fence shall hereafter be constructed, and no natural fence shall hereafter be planted within the boundaries of the Village. (Ord. 209-74, 7-9-1974)
8-4-3: EXEMPTIONS FROM PROVISIONS:
This chapter shall not apply to:
A. Fencing of swimming pools 1 . (Ord. 1100-05, 1-24-2005)
B. Land zoned Agricultural District (AG) or Agricultural Business District (AB) and used for agricultural or agricultural business purposes within the Village, provided said fence meets the following standard:
1. Maximum height shall be eight feet (8'). (Ord. 1628-16, 2-22-2016)
C. Dog runs, provided said dog runs meet the following standards:
1. Minimum height shall be four feet (4').
2. Maximum height shall be six feet (6').
3. Maximum area shall be two hundred (200) square feet.
4. Maximum width shall be fifteen feet (15').
5. Maximum length of any side shall be twenty feet (20').
6. The dog run shall be constructed of either chainlink with black vinyl coating, wrought iron, or material similar to wrought iron.
7. Landscaping shall be planted to achieve one hundred percent (100%) opacity at the time of installation. One hundred percent (100%) opacity shall be maintained twelve (12) months per year.
8. An inside corner of the house or alcove shall be used to screen the dog run, if available.
9. The dog run shall not be visible from the street.
10. The dog run must be attached to the house; if the dog run is rectangular in shape, the longest side of the dog run must be attached to the house. (Ord. 1100-05, 1-24-2005)
D. Land zoned municipal and used for Municipal purposes within the Village. (Ord. 1611-15, 11-23-2015)
E. Seasonal garden fencing, provided said seasonal garden fencing meets the following standards:
1. Maximum height of fencing shall be two feet (2') from grade, not artificial built up soil mounding.
2. Fencing color shall be neutral in tone, such as silver/gray, black, green, or brown.
3. Fencing design shall be open type with clear visible openings (e.g., wire mesh). Snow fences, construction fences, or tarps (tarpaulins) of any kind shall not be permitted.
4. Maximum of two (2) fenced gardens shall be allowable per residential property.
5. Each fence shall enclose or surround an active or operative garden area with live plantings, no greater than one hundred forty four (144) square feet.
6. Fencing shall only be located in the rear yard.
7. Minimum of five feet (5') from property line.
8. No fencing shall be allowed between November 1st and March 1st of each year. (Ord. 1814-18, 2-26-2018)
